Oz Fox Music Consulting for Guitar, Recording and General Music Topics
Sec 1. These terms are to be read and agreed upon by the consumer known as "the client." It is understood that Oz Fox known as "the consultant" is being hired to appear online with the client for the time agreed upon by email at the rate of no less than and at a minimum of $100.00 US currency per hour. Any appointments requested for less time will be at the same rate. Any international transactions will be done so at the going rate of currency to the $US at the time of transaction.
Sec 2. The consultant will make connections online via "Skype." No other platform will be used at this time. The client agrees to use this platform for consultant's sessions and is responsible for downloading Skype and acquiring proper internet speeds to engage. The consultant will not be responsible for any damage caused by downloading Skype to the client's computer, tablet, phone or any other social media device. The client is responsible for his or her own equipment in maintaining the proper internet connection while the consultant session is taking place. Consultant is not responsible for any interruptions that take place due to slow internet speeds or abrupt disconnections.
Sec 3. All payments must be made NO LESS THAN 5 DAYS IN ADVANCE of scheduled session via credit card through PAYPAL and sent to consultant's PayPal email account. A payment email confirmation will be sent as soon as possible by consultant after payment is scheduled. The client should have a PayPal account to implement payment. If there is any problem with the client's credit card authorizing payment, the client will be notified by email and the clients appointment will be suspended until payment is made.
If client wishes to pay by normal mail, a request must be made with the form below by checking the "pay by mail" box. A postal mail address will be emailed back to you as soon as possible. Payment can be made by money order or cashier's check. No personal checks will be accepted. Cash will not be accepted. Appointments will be scheduled and confirmed via email after payment is received.
Sec 4. Bookings must be made with the form below by the client and confirmed by consultant no less than 5 days in advance and session times are subject to availability between the hours of 12:00pm and 5:00pm US Pacific Standard Time, Monday thru Friday. Appointment changes must be made by email within 24 hours of appointed time. If the client cannot make the scheduled appointment, a time can be rescheduled at the consultant's discretion and availability. There will be no refunds.
Sec 5. Scheduled bookings, unless they are properly rescheduled per section 4, start at the time agreed upon, whether the client has connected or not. If client does not connect by 15 minutes into session, the clients time will be forfeited and payment will not be refunded.
All bookings are subject to consultant's availability. There is no guarantee of regular booking schedules. (i.e. weekly or monthly sessions) Any appointment cancelled by the consultant via email will be rescheduled at the earliest possible time.
Sec 6. There will be a strict limit on topics during sessions. Topics should be based on guitar playing and instruction, recording arts and basic music subjects. There should not be any questions or topics brought up about the following:
1.Any Stryper, Bloodgood, Vinyl Tattoo, Let It Rock or DiMino related business.
2.
Any personal information about the consultant or any of his associates.
3.
Subjects that question the sincerity of the consultant's beliefs.
4.
Any subject that the consultant feels is inappropriate.
If the consultant gives a warning that the above list is being violated and the client does not cease the violation during any part of the booked session, the consultant has the right to immediately cancel the session and payment will be forfeited. There will be no refunds.
Sec 7. The language of the consultant is English. If the client cannot speak or properly understand English, an interpreter must be provided and present with the client at the client's expense. If the consultant cannot understand the language of the client and no interpreter is present, the booked session will immediately be cancelled and payment will be forfeited. There will be no refunds.
Sec 8. During the session the client must be fully clothed and wearing appropriate public attire. Foul or rude language or inappropriate images on clothing will not be tolerated. The consultant may ask the client to change attire to something more appropriate and there will be no pause in the session time taken to do so. If the client refuses to comply, the consultant has the right to immediately cancel the session and payment will be forfeited. There will be no refunds.
Sec 9. Sessions will be monitored and recorded by video camera and retained by consultant. Harassment or threats will not be tolerated and will be reported to the proper legal authorities. Video archives are the property of the consultant and will not be available to anyone without expressed written consent of consultant.
Sec 10. Any unauthorized distribution of consultant's sessions, audio, video or images is prohibited and subject to civil and/or criminal penalties.
Sec 11. The consultant gives no guarantee that the knowledge or information shared will be effective to advance the clients interests/needs. The consultant will, to the best of his abilities and knowledge, share his music related skills or opinions that are appropriate to the client's musical skill level and/or knowledge. It is agreed that the client is merely paying for time spent with the consultant and no other obligations or special relationships are implied or inferred.
Sec 12. Any interaction between consultant and client is business in nature only. There is no guarantee that the consultant will have regular and frequent conversation with the client via phone, text, email or any social media connections.
Sec 13. The consultant reserves the right to refuse service to anyone without reprocussions of any kind.
Sec 14. Payment to consultant is confirmation that client has read, understands and agrees to the terms and conditions of consultant's services.
